Terms of service

These terms govern your use of PromptLab (the "Service"), operated by Going Merry ("we", "us"). By creating an account you agree to them. This is a draft for launch and should be reviewed by counsel before general availability.

1. Accounts and workspaces

You must provide accurate information and keep your credentials secure. A workspace owner is responsible for the activity of every member they invite and for charges incurred by the workspace.

2. Credits and billing

• Plan credits are granted at the start of each billing period and roll over up to one period's allotment.
• Top-up packs are one-time purchases, never expire, and are consumed after plan credits.
• Credits are consumed only for successful generations; failed or moderated runs are not charged.
• Credits have no cash value, cannot be transferred between workspaces, and are non-refundable except where required by law.
• Subscriptions renew automatically until cancelled from the billing portal. Cancellation takes effect at the end of the current period.

3. Acceptable use

You may not use the Service to create content that is unlawful, infringes third-party rights, depicts real people without consent in a misleading way, or violates the usage policies of the underlying model providers. We may suspend workspaces that breach these rules.

4. Your content and outputs

You retain all rights to prompts and reference material you upload. Subject to the licence terms of each model provider, you may use outputs generated on paid plans for commercial purposes. Outputs on the Free plan are for evaluation. We store outputs so you can retrieve them; you can delete them at any time.

5. Third-party models

Generations are performed by third-party models reached through our infrastructure providers. Model availability, behaviour and pricing may change without notice; the in-app estimate is the authoritative cost for a run.

6. Availability and liability

The Service is provided "as is". To the maximum extent permitted by law our aggregate liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

7. Changes

We may update these terms; material changes will be announced in the app or by email at least 14 days before they take effect.
